Privacy Policy

This Privacy Policy explains how Sendmint (operated by Sendmint Technologies Ltd, "Sendmint", "we", "us" or "our") collects, uses, shares and protects personal data when you visit our website at sendmint.app (the "Site"), join our waitlist, or communicate with us. It also explains the choices and rights you have in relation to your personal data.

Sendmint is currently in private access. The Site exists to describe our upcoming product and to let you join a waitlist. When the Sendmint app launches, the use of the app, including identity verification (KYC) and transaction data, will be governed by a separate, in-app privacy notice that we will present to you before you open an account.

1. Who is responsible for your data

For personal data collected through the Site, the data controller is Sendmint Technologies Ltd. You can reach us about anything in this Policy at legal@sendmint.app.

2. Personal data we collect

Data you give us

  • Waitlist data. Your email address, and any optional information you choose to include when you sign up for the waitlist.
  • Communications. The contents of messages you send us (for example by email or social media), and our replies.

Data collected automatically

  • Usage and device data. IP address, browser type, operating system, referring pages, pages viewed, and the dates and times of visits.
  • Cookies and similar technologies. Small files stored on your device that help the Site function and help us understand how it is used (see Section 5).

We do not collect financial account details, government identifiers, or identity documents through the Site. Those categories will only be collected inside the Sendmint app, under its own notice, when it launches.

3. How we use personal data

  • To operate the waitlist and tell you when access opens;
  • To send you product updates and launch announcements about Sendmint (you can opt out at any time; every email includes an unsubscribe link);
  • To respond to your questions and support requests;
  • To operate, secure and improve the Site, including monitoring for fraud, abuse and technical issues;
  • To comply with applicable law, regulation and lawful requests from authorities; and
  • To establish, exercise or defend legal claims where necessary.

We do not sell your personal data, and we do not use it for third-party advertising.

4. Legal bases

Where the Nigeria Data Protection Act 2023 (NDPA), the EU/UK GDPR or similar laws apply, we rely on: consent (joining the waitlist, receiving marketing, non-essential cookies), our legitimate interests (operating, securing and improving the Site, and communicating with people who contact us), and compliance with legal obligations. Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing before withdrawal.

5. Cookies

We use strictly necessary cookies to make the Site work, and, where you consent, analytics cookies to understand how visitors use the Site so we can improve it. You can control cookies through your browser settings; blocking some types may affect how the Site functions.

6. How we share personal data

We share personal data only with:

  • Service providers who process data on our behalf and under contract, such as hosting, email delivery and analytics providers, and only to the extent needed to provide their services;
  • Professional advisers (lawyers, auditors, insurers) where reasonably necessary;
  • Authorities and other parties where required by law, including to comply with a legal obligation, protect our rights, or prevent fraud or harm; and
  • A successor entity in connection with a merger, acquisition, financing or sale of assets, in which case this Policy will continue to apply to your data until you are told otherwise.

7. International transfers

Our service providers may store or process data outside your country, including outside Nigeria, the EEA or the UK. Where they do, we take steps required by applicable law to protect it, such as transferring to countries with adequate protection or using appropriate contractual safeguards.

8. How long we keep data

We keep waitlist data until you unsubscribe or until the waitlist programme ends, and communications for as long as needed to handle the matter and for a reasonable period afterwards. Usage data is retained in identifiable form only as long as needed for the purposes above. We may retain data longer where the law requires it or where it is needed for legal claims, after which it is deleted or anonymised.

9. Security

We use technical and organisational measures appropriate to the risk, including encryption in transit, access controls and least-privilege practices, to protect personal data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security; if a breach affecting your data occurs, we will notify you and the relevant authorities where the law requires it.

10. Your rights

Depending on where you live, you may have the right to: access the personal data we hold about you; correct inaccurate data; delete your data; object to or restrict certain processing; receive a portable copy of data you provided; withdraw consent; and lodge a complaint with a supervisory authority: in Nigeria, the Nigeria Data Protection Commission (NDPC); in the EEA or UK, your local data protection authority.

To exercise any of these rights, email legal@sendmint.app. We may need to verify your identity before acting on a request, and we will respond within the time required by applicable law.

11. Children

The Site and our services are not directed at anyone under 18, and we do not knowingly collect personal data from children. If you believe a child has provided us personal data, contact us and we will delete it.

12. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or a notice on the Site. Your continued use of the Site after changes take effect means the updated Policy applies.
